UA
What is mediation?
Mediation is a structural negotiation process
with a neutral mediator involved.
The role of a neutral mediator is to help stakeholders understand their situation and reach a solution that satisfies interests of both conflicting parties. It may include assisting the parties in finding agreements, dispute resolution, establishing effective communications, building or improving relationship, or all this together.

Mediator doesn't take sides of conflicting parties. Mediator is impartial with neutral position.
Basic principles of mediation:
Voluntary participation in the process
Confidentiality of the process
Neutrality, impartiality and independence of mediator
Self-determination of the parties (the parties make their own decisions)
Ensures establishing effective communication, building and improving relationship between the conflicting parties
Creates conditions for constructive cooperation in which parties can hear and understand each other's needs
Facilitates negotiation process aimed to find mutually acceptable solutions
Mediator's role and responsibility:
Main features of mediation:
mediation is a special type of negotiation with a certain structure

mandatory participation of a mediator

mediator does not represent any of the conflicting parties

mediator facilitates/assists the parties in negotiating and reaching mutually acceptable solution

mediator does not force the parties to make a specific decision, does not give advice on possible decisions

the parties' active role in negotiation to find possible solutions on their own

mediation is a special form of negotiation, and its nature is determined by mediator's place and role in this process
Mediation may be the best way
to resolve disputes where:
Communication between the parties is interrupted
Due to strong negative emotions, direct negotiations have come to deadlock
You need to avoid publicity and keep your reputation
There is concern that court will not satisfy interests of the parties
It's important to maintain relationship

Mediator Supervision
Service "Mediator Supervision"

Mediator supervision is one of the methods of theoretical and practical professional development of specialists in the field of mediation in the form of professional consulting and analysis of suitability and quality of practical approaches they use in their work.

Mediation is a profession, and training itself is not enough for effective work no matter how much training. One can learn the process, master methods and get acquainted with the theory of conflict, but each case will be individual, with its own characteristics and difficulties in work, and this personal mediator's experience can't be replaced by any manual or training. Moreover, this experience may be so traumatic that mediators leave the profession without having understood all the depth and effectiveness of it.

In supervision, an experienced mediator helps a beginner in profession to see, become aware, understand and analyze her/his professional actions and professional behavior.

One of the tasks in supervision is to allow mediator feel his/her emotional experience in a safer environment, where you can get through it, reflect it and get out of the mediator.

Such relationship with supervisor can give a mediator the opportunity to find new ways to solve the issue, her/his resource potential, learn about areas of personal development and seek for emotional support.

The educational function of supervision includes development of professional skills, understanding and competencies of the mediator. It is provided through analysis and exploring of the mediator's work with her/his clients.

In the process of such study, supervisor can help the mediator:

  • better understand the participants of mediation process;

  • be better aware of his/her own reactions on conflicting parties;

  • understand dynamics of relationship with parties and between them;

  • analyze his/her interventions and their consistency;

  • explore other ways to deal with this and similar situations.
